Service Agreement

Plans & Subscriptions

Our services are offered as monthly or annual subscriptions. Your plan determines the scope of work, including number of pages, features, support level, and included services such as hosting, SEO, eCommerce, lead generation, or automations.

• Your subscription begins when your first payment is processed and continues until cancelled.
• Plans renew automatically each billing cycle unless cancelled before the renewal date.
• You may upgrade or downgrade your plan; changes take effect at the next billing cycle.

Billing & Payments

• Subscription fees are billed in advance on a recurring basis through our payment providers.
• Annual plans are billed once per year at the discounted rate shown at checkout.
• Setup or one-time fees, if any, are disclosed before you subscribe.
• Payments are non-refundable except where required by law or expressly stated in writing.

If a payment fails, we will attempt to reach you to update your billing details. Sites may be paused if an account becomes significantly past due.

What We Provide

Within the scope of your plan, we provide:

• Custom website design and development built around your brand.
• Managed hosting with SSL, a content delivery network, daily backups, and security monitoring.
• Content and design update requests included in every plan. You submit a request, we handle it. Turnaround times and queue priority vary by plan tier as described in the Change & Update Requests section below.
• Additional services you have selected, such as SEO and reporting, eCommerce and booking, lead capture, or automations.
• Support through the channels and response times described in your plan.

Change & Update Requests

Every Jet Black Design plan includes content and design update requests at no additional charge. You submit a request through your client portal, support ticket, or direct message, and we handle the work for you. No technical skills or access to your website are required on your part.

Turnaround by Plan Tier

• Lite: Content and design update requests are handled within 48 business hours.
• Core: Content and design update requests are handled the same business day.
• Growth: Update requests are placed in a priority queue and handled the same business day.
• Scale: Update requests receive dedicated, same-day handling with a named point of contact.

What Is Included

• Text, copy, and content changes across any page on your site.
• Image swaps, gallery additions, and media updates.
• Color, font, layout, and design adjustments within your existing design system.
• Form additions or edits, button changes, and navigation updates.
• Blog posts, news entries, event listings, and team or staff page updates.

What Requires a Separate Quote

• Full page redesigns or the addition of new pages beyond your plan’s page limit.
• New features or functionality not included in your current plan (e.g., eCommerce, booking systems, CRM setup).
• Custom integrations with third-party platforms.
• Structural or architectural changes that alter the site’s core framework.

We use AI-assisted tools internally to handle requests efficiently and accurately. This allows us to turn around updates faster than traditional agencies without additional cost to you. The quality and accuracy of every update remains our responsibility.

Your Responsibilities

To help us deliver on time, you agree to:

• Provide accurate information, content, and materials we need to build and maintain your site.
• Confirm that you own or have the rights to all content, images, and assets you supply.
• Review and respond to requests for approval within a reasonable time.
• Use the services lawfully and not for prohibited or infringing purposes.

Ownership & Licensing

You own the content you provide and the final website design we deliver for your project once your account is in good standing. We retain ownership of our underlying tools, frameworks, templates, and any pre-existing materials, and we grant you a license to use them as part of your active subscription.

Because hosting, security, and maintenance are part of the service, certain managed infrastructure remains with us while your plan is active.

Cancellation & Termination

You may cancel your subscription at any time, effective at the end of your current billing cycle. We may suspend or terminate services if these terms are violated, payments remain unpaid, or the services are misused.

• On cancellation, recurring billing stops and active services, including hosting and management, end at the close of the paid period.
• On request, we will provide a reasonable export of your site content so you can migrate elsewhere.
• Completed, fully paid design work may be transferred to you in accordance with the Ownership section.

Service Levels & Disclaimers

We aim for 99.9% hosting uptime. Change and update requests are handled within the turnaround windows described in the Change & Update Requests section. Support inquiries are responded to as quickly as reasonably possible within your plan tier. Apart from any commitments expressly stated in this Agreement, our services are provided “as is” without warranties of any kind, and results such as search rankings, traffic, or sales cannot be guaranteed.

Limitation of Liability

To the fullest extent permitted by law, our total liability for any claim relating to the services is limited to the amount you paid us in the three months before the claim arose. We are not liable for indirect, incidental, or consequential damages.

Changes to This Agreement

We may update this Agreement to reflect changes in our services or the law. We will post updates here with a revised effective date and, for material changes, make reasonable efforts to notify active clients. Continued use of the services after an update means you accept the revised Agreement.
